Perhaps, but it's what you do with the setting. My favorite example: Company of Heroes. One in a far too long line of WW2 games, but it beats the shit out of most of 'em because it's just a good game.

And about Vista: if you haven't used it, don't trash it. I've heard the same Internet Verdict (which is to say, meme) that it's shitty, but no one I actually know has had any problems with it.
